• Accuracy of Information: While we make every effort to ensure the accuracy and reliability of the information provided, we do not guarantee the completeness, accuracy, or timeliness of any information or content related to the tour. It is the responsibility of the tourist to verify and confirm the details, including but not limited to schedules, itineraries, prices, and availability, before making any bookings or decisions.
• Standard of Living and Conditions: The standards of living, utilities, services, food, and accommodations can vary from country to country or place to place. It is important to understand that living conditions may differ from what you are accustomed to in your home country or other destinations. We shall not be held responsible for any illness, inconvenience, or dissatisfaction resulting from such variations in services provided or omitted.
• Changes in Costs and Charges: The cost of the tour is based on prevailing rates negotiated with hotels, car rentals, and ferry tickets, among others. However, please be aware that entrance fees, taxes, fuel costs, guide charges, or any other fees imposed by the government of India or other relevant authorities may change after the finalization of the tour/service cost. Any such changes will be charged as extra, and the tourist will be notified accordingly.
• Limitation of Liability: Andaman Ocean Tours and Travels acts as an agent for hotels, transporters, and contractors providing various services. We shall not be held liable for any injury, loss, personal harm, death, damage, or any direct or indirect damages incurred during the tour, including but not limited to natural hazards, flight/ship delays, accidents, breakdowns, sickness, weather conditions, political closures, or any other unforeseen incidents beyond our control.
• Baggage and Personal Belongings: The tourist is solely responsible for their baggage and personal belongings at all times. We shall not be held responsible for any loss, damage, theft, or misplacement of the tourist’s baggage or personal property during the tour. It is recommended to keep valuables, money, and important travel documents in safe deposit lockers and take necessary precautions.
• Compliance with Laws and Regulations: All tourists, including NRIs (Non-Resident Indians) and foreigners, are required to abide by the laws, rules, and regulations of the Government of India and the respective countries visited during the tour. Any non-compliance shall be the sole responsibility of the tourist, and we shall not be liable for any consequences arising from such non-compliance.
• Independent Contractors and Third Parties: We act as an intermediary between tourists and independent contractors providing various services. Any grievances, complaints, or claims in respect to the services provided by independent contractors should be immediately reported in writing to the concerned contractor and a copy provided to the tour escort/leader/manager/assistant and/or our company within 7 days. We will make reasonable efforts to assist in resolving the matter.
• Jurisdiction: All disputes, claims, and legal proceedings arising from the tour and these terms and conditions shall be subject to the jurisdiction of the Court of competent jurisdiction at Port Blair, Andaman & Nicobar Islands, India.
• Severability: If any provision of these terms and conditions is declared invalid, illegal, or unenforceable, it shall not affect the validity or enforceability of the remaining provisions. Each provision is considered separate and independent.
